Imprisonment a possibility for first-offense DUIs in Florida

A person can have many fears when they are facing allegations of a first-offense of drunk driving. One is a fear of imprisonment.

Can incarceration be on the table for a first conviction of DUI here in Florida? Yes, a sentence including imprisonment is a possibility in such a situation.

Under Florida law, the maximum amount of imprisonment a person typically can be given for a first-offense of DUI is six months. However, state law does set out a couple circumstances under which up to nine months of imprisonment can be given for such an offense. Such an upped maximum sentence can be given if the offense occurred while there was a minor in the vehicle or the driver’s blood alcohol level was at least 0.15.

So, among the things individuals here in Florida may have questions on when accused of drunk driving for the first time is what steps they can take to try to prevent the accusation from resulting in imprisonment. There are a variety of different options that might be available in a DUI case for trying to avoid jail time. Many factors can contribute to what options would be available and realistic ones in a given case. Experienced DUI defense attorneys can provide individuals accused of a first-offense DUI here in Florida with guidance on what defense approaches might help with the key goals they have in their case, such as the goal of avoiding jail time, in light of the specific circumstances of their case.
