EB-3 one of the green card routes for foreign workers

There are five employment-based green card categories here in the United States. Today’s post will be focused on one of them: the EB-3 category.

This green card category is for three different classes of workers from foreign countries. The three classes in question are:

  • Professionals. This covers workers with a baccalaureate degree (or equivalent) who work in jobs that generally require such a degree.
  • Skilled workers: This covers workers with two or more years of experience/training.
  • Other workers: This covers workers in unskilled labor.

Can a worker who falls into one of these three classes petition for an EB-3 green card on their own? They cannot. They can only be eligible for such a green card if they have a job offer from an employer in the U.S., and their employer has to petition for them.

Another thing a worker generally needs from their employer in order to have EB-3 eligibility is for their employer to go through the labor certification process in relation to them.

While the EB-3 application process involves many actions by a worker’s employer, it can still be very important for a worker to stay properly informed during the course of this process. Having the right information and guidance during this process can help a worker understand what options they have for responding to hiccups that come up during the process and what mistakes it is important for them to stay clear of.
